الشروط والأحكام

١. نطاق التطبيق

١.١ تحكم هذه الشروط والأحكام ("الشروط") العلاقة التعاقدية بين نجمتي، وهي شركة تجارة إلكترونية مسجلة قانونياً في المملكة العربية السعودية (رقم معروف: ٣٦٤٧٣١)، ويُشار إليها فيما بعد بـ "الشركة" أو "نجمتي"، وبين العميل، ويُشار إليه فيما بعد بـ "العميل". تسري هذه الشروط على جميع المبيعات الخاصة بالخرائط النجمية المخصصة والخدمات ذات الصلة المقدمة عبر منصة التجارة الإلكترونية الخاصة بالشركة وجميع نطاقاتها الفرعية.

١.٢ بدخول العميل إلى موقعنا الإلكتروني أو تصفحه أو تقديم طلب عبره، فإنه يوافق صراحة على الالتزام بهذه الشروط وأي شروط أو سياسات إضافية يشار إليها هنا. وفي حال عدم موافقة العميل على هذه الشروط، يتعين عليه الامتناع عن استخدام الموقع أو خدماته.

 

 

٢. إبرام العقد

٢.١ جميع المنتجات المعروضة على موقع نجمتي تعد دعوة غير ملزمة للعميل لتقديم عرض شراء. ويتم إبرام عقد ملزم فقط عند قبول نجمتي لطلب العميل من خلال إرسال تأكيد رسمي عبر البريد الإلكتروني.

٢.٢ يتحمل العميل المسؤولية الكاملة عن دقة جميع البيانات التي يقدمها أثناء عملية الطلب، بما في ذلك (تاريخ ووقت ومكان الخريطة النجمية، وعنوان التوصيل، ومعلومات الاتصال). ووفقاً للمادة (٤) من نظام التجارة الإلكترونية السعودي، يحق للعميل تصحيح أي أخطاء في بيانات الطلب قبل إتمام المعالجة.

٢.٣ يمكن إبرام العقد باللغة العربية أو الإنجليزية، وفي حال وجود أي تعارض بين النسختين، تسود النسخة العربية وفقاً للأعراف القانونية في المملكة.

 

 

٣. حق الانسحاب

٣.١ وفقاً للمادة (١٣) من نظام التجارة الإلكترونية السعودي، لا ينطبق حق الانسحاب على المنتجات المخصصة أو المصممة خصيصاً. ونظراً للطبيعة الشخصية لمنتجاتنا (الخرائط النجمية)، فجميع المبيعات نهائية.

٣.٢ على الرغم من ذلك، تلتزم نجمتي برضا العملاء. يرجى الرجوع إلى القسم (٦) المتعلق بالمنتجات المعيبة.

 

 

٤. الأسعار وشروط الدفع

٤.١ جميع الأسعار مدرجة بالريال السعودي (SAR) وتشمل ضريبة القيمة المضافة (VAT) حيثما ينطبق.

٤.٢ نقبل الدفع عبر:

  • مدى

  • فيزا

  • ماستركارد

  • أبل باي

  • وغيرها من الوسائل الموضحة عند إتمام الدفع.

٤.٣ يجب سداد قيمة الطلب كاملة عند إجرائه. ولا تتم معالجة أو تنفيذ الطلبات إلا بعد استلام الدفعة بنجاح.

٤.٤ عند إبرام العقد، يستلم العميل فاتورة إلكترونية تفصيلية بجميع الرسوم، وذلك وفقاً للمادة (٨) من نظام التجارة الإلكترونية السعودي.

 

 

٥. شروط التسليم

٥.١ مدة التسليم الاعتيادية داخل المملكة تتراوح بين (٣–٧) أيام عمل.

٥.٢ لا تتحمل نجمتي أي مسؤولية عن التأخير الناتج عن شركات الشحن، أو القوة القاهرة (مثل الكوارث الطبيعية أو القرارات الحكومية)، أو العطل الرسمية.

٥.٣ في حال فشل التسليم بسبب إدخال العميل لعنوان غير صحيح أو لغيابه عند التسليم، يتحمل العميل كافة رسوم إعادة الشحن.

 

 

٦. الإرجاع والاسترداد والإلغاء

٦.١ لا يمكن إلغاء أو استرجاع أو استرداد قيمة المنتجات المخصصة بعد بدء المعالجة، إلا في حالة وجود عيب مثبت.

٦.٢ يعتبر المنتج معيبا إذا:

  • تعرض لتلف كبير أثناء النقل.

  • احتوى على خطأ إنتاج أو طباعة مثبت، غير ناتج عن بيانات غير دقيقة قدمها العميل.

٦.٣ يجب على العميل إخطار نجمتي كتابياً خلال سبعة (٧) أيام من استلام المنتج، مع تقديم صور أو فيديو يثبت العيب. عدم تقديم الأدلة خلال هذه المدة يسقط حق المطالبة.

٦.٤ إذا ثبتت المطالبة، يتم تزويد العميل برقم إرجاع (RMA) وتعليمات الإرجاع. يتم استرداد المبلغ إلى وسيلة الدفع الأصلية بعد استلام المنتج المعيب وفحصه.

 

 

٧. شروط خاصة بالمنتجات المخصصة

٧.١ يتم إنشاء الخريطة النجمية اعتماداً على البيانات التي يقدمها العميل (التاريخ، الوقت، الموقع). ولا تتحمل نجمتي أي مسؤولية عن الأخطاء الناتجة عن بيانات غير دقيقة.

٧.٢ تحتفظ نجمتي بالحق في رفض أي طلب يتضمن بيانات أو محتوى مخالفاً لأنظمة المملكة أو النظام العام أو الآداب العامة، أو منتهكاً لحقوق الملكية الفكرية لطرف ثالث.

 

 

٨. القسائم الترويجية

٨.١ القسائم الترويجية صالحة للاستخدام مرة واحدة فقط ضمن الفترة المحددة.

٨.٢ لا يمكن استردادها نقداً أو دمجها مع عروض أخرى، وهي غير قابلة للتحويل.

 

 

٩. بطاقات الهدايا

٩.١ بطاقات الهدايا صالحة للاستخدام حصراً عبر موقع نجمتي.

٩.٢ صلاحية البطاقة اثنا عشر (١٢) شهراً من تاريخ الشراء.

٩.٣ إذا كانت قيمة البطاقة أقل من قيمة الطلب، يجب على العميل سداد الفرق عبر وسائل الدفع الأخرى المتاحة.

 

 

١٠. حقوق الملكية الفكرية

١٠.١ جميع المحتويات والتصاميم والخرائط النجمية على موقع نجمتي محمية بموجب أنظمة الملكية الفكرية في المملكة والاتفاقيات الدولية.

١٠.٢ يمنح العميل ترخيصاً محدوداً لاستخدام المنتج لأغراض شخصية وغير تجارية. ويُمنع إعادة إنتاج أو إعادة بيع أو استغلال أي جزء دون إذن خطي مسبق من نجمتي.

 

 

١١. مسؤوليات العميل

١١.١ يتحمل العميل مسؤولية دقة واكتمال جميع البيانات المقدمة.

١١.٢ لا تتحمل نجمتي أي مسؤولية عن أية مشاكل ناجمة عن بيانات غير صحيحة أو غير مكتملة.

 

 

١٢. حدود المسؤولية

١٢.١ في حدود ما يسمح به النظام السعودي، لا تتحمل نجمتي أي مسؤولية عن الأضرار غير المباشرة أو الخاصة أو التبعية (بما في ذلك خسارة الأرباح أو البيانات).

١٢.٢ في جميع الأحوال، لا تتجاوز المسؤولية الإجمالية لنجمتي قيمة المنتج محل المطالبة فقط.

 

 

١٣. الخصوصية وحماية البيانات (نظام حماية البيانات الشخصية – PDPL)

١٣.١ تلتزم نجمتي التزاماً كاملاً بنظام حماية البيانات الشخصية السعودي (المرسوم الملكي م/١٩ بتاريخ ٩/٢/١٤٤٤هـ).

١٣.٢ تشمل مبادئ المعالجة لدينا:

  • الغرض المحدد: استخدام البيانات فقط للغرض الذي جُمعت من أجله.

  • تقليل البيانات: جمع الحد الأدنى اللازم.

  • الموافقة: الحصول على موافقة صريحة من العميل على المعالجة.

  • حقوق العميل: الحق في الوصول والتصحيح والحذف.

  • الإبلاغ عن الخروقات: إخطار الجهات المختصة والعملاء عند حدوث خرق أمني.

 

 

١٤. الامتثال لنظام التجارة الإلكترونية السعودي

١٤.١ تعمل نجمتي وفق نظام التجارة الإلكترونية (المرسوم الملكي م/١٢٦ لسنة ٢٠١٩م).

١٤.٢ تشمل التزاماتنا:

  • أن تكون الإعلانات والمنتجات واضحة وصحيحة وغير مضللة (المادتان ١٠ و١١).

  • توفير معلومات منصة واضحة (المادة ٦).

  • تمكين العميل من تصحيح البيانات (المادة ٤).

 

 

١٥. القانون والاختصاص القضائي

١٥.١ تخضع هذه الشروط وتُفسر وفق أنظمة المملكة العربية السعودية حصراً.

١٥.٢ تختص المحاكم السعودية حصرياً بالفصل في أي نزاع ينشأ عن هذه الشروط.

 

 

١٦. التعديلات على الشروط

١٦.١ تحتفظ نجمتي بالحق في تعديل هذه الشروط في أي وقت. وتُعتبر نافذة فور نشرها على الموقع.

1. Scope of Application

1.1 These Terms & Conditions (“T&Cs”) govern the contractual relationship between Nejmaty, an e-commerce business legally registered in the Kingdom of Saudi Arabia (Maroof Number: 364731), hereinafter referred to as "the Company" or “Nejmaty,” and you, the customer, hereinafter referred to as "the Customer." These T&Cs apply to all sales of customized star maps and related services offered through the Company’s e-commerce platform and its subdomains.

1.2 By accessing, browsing, or placing an order on our website, the Customer expressly agrees to be bound by these T&Cs and any additional terms, conditions, or policies incorporated by reference. Should the Customer not agree to all the T&Cs, they must not use the website or its services.

 

 

2. Conclusion of the Contract

2.1 All product listings on the Nejmaty website constitute a non-binding invitation to the Customer to make an offer. A binding and enforceable contract is concluded only when Nejmaty accepts the Customer's order by issuing a formal order confirmation via email.

2.2 The Customer is solely responsible for the accuracy of all information provided during the order process, including but not limited to the date, time, and location for the star map, as well as delivery and contact information. In accordance with Article 4 of the Saudi E-Commerce Law, the Customer has the right to rectify any errors in their order details promptly before the order is processed.

2.3 The contract may be concluded in either the Arabic or English language. In the event of any discrepancy between the two versions, the Arabic version shall prevail, as required by Saudi legal precedent.

 

 

3. Right of Withdrawal

3.1 As stated in Article 13 of the Saudi E-Commerce Law, the general right of withdrawal does not apply to customized or personalized goods. Therefore, due to the bespoke nature of our star maps, which are created specifically for each Customer, all sales are final.

3.2 Notwithstanding the above, Nejmaty is committed to ensuring customer satisfaction. Please refer to Section 6 for our policy on defective products.

 

 

4. Prices and Payment Terms

4.1 All prices are listed in Saudi Riyals (SAR) and are inclusive of Value Added Tax (VAT) where applicable.

4.2 We accept payment via Mada, Visa, Mastercard, Apple Pay, and other payment methods as presented at the time of checkout.

4.3 Full and complete payment is required at the time the order is placed. The order will not be processed or fulfilled until payment has been successfully received.

4.4 Upon the conclusion of the contract, the Customer will receive a detailed electronic invoice outlining all charges, in compliance with Article 8 of the Saudi E-Commerce Law.

 

 

5. Delivery Conditions

5.1 Standard delivery timelines are estimates, and Nejmaty shall not be held liable for any delays that may occur due to the actions of third-party courier services, force majeure events (including but not limited to natural disasters, war, or government restrictions), or public holidays.

5.2 If delivery fails due to the Customer providing an incorrect or incomplete address, or due to the Customer's absence at the time of delivery, the Customer shall be liable for any and all additional re-delivery charges.

 

 

6. Returns, Refunds & Cancellations

6.1 Due to the highly personalized nature of our products, orders cannot be canceled, returned, or refunded once processing has begun, except in the case of a proven defect.

6.2 A product is considered defective if it has:

  • Incurred significant damage during transit.

  • A verifiable production or printing error not caused by inaccurate information provided by the Customer.

6.3 To claim a refund for a defective product, the Customer must notify Nejmaty in writing within seven (7) days of receiving the product. This notification must be accompanied by clear photographic or video evidence demonstrating the defect. Failure to provide such evidence within the stipulated timeframe will result in the forfeiture of any claim.

6.4 If a claim is validated by Nejmaty, the Customer will be provided with a return merchandise authorization (RMA) number and instructions for the return. Refunds will be processed to the original payment method within a reasonable timeframe following the successful return and inspection of the defective product.

 

 

7. Special Conditions for Customized Goods

7.1 The creation of the star map is based exclusively on the data (date, time, location) provided by the Customer. Nejmaty accepts no liability for any errors or inaccuracies in the final product that are a direct result of incorrect information provided by the Customer.

7.2 Nejmaty reserves the right to reject any order that contains content or information that is deemed to violate the laws of the Kingdom of Saudi Arabia, public order, or moral values, or that infringes upon the intellectual property rights of any third party.

 

 

8. Promotional Vouchers

8.1 Promotional vouchers are valid for one-time use on the Nejmaty website and are subject to the specific terms and expiry dates stated on the voucher.

8.2 Vouchers are non-transferable, non-refundable, cannot be exchanged for cash, and may not be used in conjunction with any other offers or discounts.

 

 

9. Gift Vouchers

9.1 Gift vouchers are redeemable exclusively on the Nejmaty website.

9.2 Each voucher has a validity period of twelve (12) months from the date of purchase.

9.3 If the value of the gift voucher is less than the total order amount, the Customer is required to pay the remaining balance using one of the other accepted payment methods.

 

 

10. Intellectual Property Rights

10.1 All content on the Nejmaty website, including but not limited to text, graphics, logos, images, and the unique design of the star maps, is the exclusive property of Nejmaty and is protected by Saudi Arabian and international intellectual property laws.

10.2 The Customer is granted a limited, non-exclusive license to use the final product for personal, non-commercial use only. Any reproduction, resale, or commercial use of the product or any of the Company's intellectual property without prior written consent from Nejmaty is strictly prohibited.

 

 

11. User Responsibilities

11.1 The Customer is responsible for ensuring the accuracy and completeness of all personal data and order information provided.

11.2 Nejmaty is not liable for any issues or damages that arise from the Customer's provision of incorrect or incomplete information.

 

 

12. Limitation of Liability

12.1 To the fullest extent permitted by Saudi Arabian law, Nejmaty shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or goodwill, arising from the use of its products or services.

12.2 In any event, Nejmaty's total aggregate liability to the Customer shall not exceed the amount paid by the Customer for the specific product that is the subject of the claim.

 

 

13. Privacy & Data Protection (PDPL)

13.1 Nejmaty is fully committed to compliance with the Saudi Personal Data Protection Law (PDPL), Royal Decree M/19 of 9/2/1444H.

13.2 We collect, process, and use personal data strictly for the purposes of order fulfillment, customer service, and, with the explicit consent of the Customer, for marketing communications.

13.3 In accordance with the PDPL, we implement robust technical and administrative safeguards to protect personal data and ensure the following principles:

  • Purpose Limitation: Data is only used for the specified purpose for which it was collected.

  • Data Minimization: We collect only the data necessary to fulfill our business purposes.

  • Consent: We obtain explicit consent from the data subject for all processing activities, as required by Article 25 of the PDPL.

  • Data Subject Rights: Customers have the right to access, correct, and request the deletion of their personal data.

  • Breach Notification: In the event of a data breach, we will provide timely notification as required by law.

  • Record of Processing Activities: We maintain a detailed record of all our data processing activities.

 

 

14. Electronic Commerce Law Compliance

14.1 Nejmaty operates in strict compliance with the Saudi E-Commerce Law (Royal Decree M/126, 2019) and its executive regulations.

14.2 Our obligations include, but are not limited to:

  • Ensuring that all electronic advertisements and product descriptions are honest, clear, and non-misleading, as mandated by Articles 10 and 11.

  • Providing transparent and accessible platform disclosure requirements as per Article 6.

  • Adhering to consumer rights for error rectification as outlined in Article 4.

 

 

15. Applicable Law & Jurisdiction

15.1 These T&Cs and any disputes arising from them shall be exclusively governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.

15.2 Any legal action or proceedings relating to the interpretation, execution, or enforcement of these T&Cs shall be submitted to the exclusive jurisdiction of the competent courts in Saudi Arabia.

 

 

16. Changes to the Terms

16.1 Nejmaty reserves the right to amend or update these T&Cs at any time. The updated T&Cs will be published on our website and will apply to all orders placed after the date of publication. It is the Customer's responsibility to review the T&Cs periodically for changes.
